Welcome to Fitness Trend ("we", "us", or "our"). These Terms of Service ("Terms") govern your download, access, and use of the Fitness Trend mobile application, services, and website located at fitnesstrend.app (collectively, the "Service").

By downloading, installing, accessing, or using Fitness Trend, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Health & Wellness Disclaimers; Assumption of Risk

A. Not Medical Advice

The Service provides automated estimates based on algorithmic analysis of your logged body weight and self-reported nutrition intake. Nothing contained within the Service should be construed as medical advice or a substitute for professional clinical judgment. Never disregard professional medical advice or delay seeking it because of information presented in this app.

B. Eligibility and Restrictions

The Service is intended solely for healthy adults aged 18 and older. The Service is not intended for, and must not be used by:

• Individuals under 18 years of age;
• Individuals who are pregnant or nursing;
• Individuals who have been diagnosed with or suspect they may have an eating disorder (including anorexia nervosa, bulimia, or orthorexia);
• Individuals with severe chronic illnesses, renal conditions, or metabolic disorders requiring medical supervision.

C. Voluntary Assumption of Risk

You expressly acknowledge that modifying your nutritional intake, restricting calories, or altering body weight carries inherent physical and psychological risks. You voluntarily assume full responsibility for all risks associated with your dietary choices, physical health, and use of the Service.

2. AI Nutritional Recognition & Estimates

A. Approximations Only

Our automated meal analysis features use artificial intelligence models to recognize food items and estimate portion sizes, calories, and macronutrients from meal photos or text descriptions. These values are algorithmic approximations and will vary from actual nutritional contents.

B. Allergen & Ingredient Disclaimer

The Service cannot detect trace allergens, preparation methods, hidden sugars, cross-contamination, or toxic ingredients. You are solely responsible for inspecting your food and confirming all ingredients, allergens, and dietary safety before consumption.

3. Subscriptions, Free Trials & Billing

A. Auto-Renewing Subscriptions

Fitness Trend offers premium access via an auto-renewing monthly subscription ("Subscription"). The subscription price ($1.99 USD per month, or local currency equivalent) and billing frequency are clearly presented before purchase.

B. 14-Day Free Trial

New eligible subscribers receive a 14-day free trial upon initiating a Subscription. Unless cancelled at least 24 hours prior to the conclusion of the 14-day trial period, the Subscription will automatically convert to a paid monthly subscription and your payment method on file will be charged $1.99 per month.

C. Managing and Cancelling Subscriptions

All payments and subscriptions are processed directly through the Google Play Store (on Android) or Apple App Store (on iOS). You can manage or cancel your subscription at any time directly through your device's store settings:

• Android: Google Play Store > Profile Icon > Payments & Subscriptions > Subscriptions (or manage online via Google Play Subscriptions).
• iOS: Settings > Apple ID > Subscriptions.

Cancelling stops future renewal charges. You will retain full access through the end of your current paid billing period.

D. Refunds

All purchases and billing transactions are governed by the refund policies of the applicable store platform (Google Play or Apple App Store). We do not directly handle financial transactions or process refunds.

4. User Accounts & Security

A. Account Creation

To access the Service, you must create an account using a valid email address or authenticated OAuth provider (Google Sign-In, Apple Sign-In). You agree to provide accurate and current information and maintain the confidentiality of your credentials.

B. Account Responsibility

You are solely responsible for all activity that occurs under your account. Notify us immediately at support@fitnesstrend.app if you suspect unauthorized access.

5. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful, harassing, or fraudulent purpose;
• Reverse engineer, decompile, disassemble, or extract source code from the Service;
• Probe, scan, or compromise the vulnerability of our cloud infrastructure or APIs;
• Upload malicious software, corrupted files, or unauthorized scripts;
• Scrape, automate, or flood our servers with excessive requests.

6. Intellectual Property Rights

All visual designs, application code, logos, user interfaces, adaptive algorithms, graphics, and trademarks are the exclusive property of Fitness Trend and its licensors. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial self-tracking.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Fitness Trend, its founders, developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, bodily injury, health complications, or emotional distress resulting from:

• Your access to or inability to use the Service;
• Any inaccuracies or errors in calorie, macronutrient, or maintenance calculations;
• Any dietary, fitness, or weight changes made in reliance on the Service;
• Unauthorized access, alteration, or deletion of your logs or account data.

In no event shall our aggregate liability for all claims arising out of or related to the Service exceed the total amount paid by you to Fitness Trend during the twelve (12) months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Fitness Trend and its creators from and against any claims, liabilities, damages, losses, and reasonable legal expenses arising out of or in any way connected with your violation of these Terms or misuse of the Service.

9. Dispute Resolution & Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

A. Informal Resolution

Before initiating formal legal action, you agree to contact us at support@fitnesstrend.app to attempt to resolve any dispute informally within thirty (30) days.

B. Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

C. Class Action Waiver

You and Fitness Trend agree that all claims must be brought in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

D. 30-Day Opt-Out Right

You have the right to opt out of this arbitration provision within thirty (30) days of first opening an account by sending written notice to support@fitnesstrend.app stating your intent to opt out.

10. Termination & Account Deletion

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by using the "Delete Account" option in the app side menu (Menu > Account > Delete Account), by reviewing our step-by-step Account & Data Deletion instructions, or by contacting support@fitnesstrend.app. Upon deletion, your personal data and logs are permanently erased from our active databases.

11. Governing Law & Severability

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. If any provision of these Terms is found unenforceable, that provision will be severed, and all remaining provisions will remain in full force and effect.
